Turks and Caicos is a group of British islands in the West Indies. Located at the southeastern end of the Bahamas, approximately 145 kilometers north of Haiti. It borders the Atlantic Ocean to the east and faces Cuba across the water to the west. Composed of over 30 small islands in the Turks and Caicos Islands.
The current trademark regulations in the Turks and Caicos Islands are mainly based on the 2002 Trademark Law, and the official language is English. Due to the fact that the Turks and Caicos Islands are a British Overseas Territory, there are two ways to register local trademarks: either by directly applying for registration protection with the local trademark registration office, or by requesting extension of protection based on UK registration or Madrid designated UK registration.
(1) Request for extended protection based on UK registration/Madrid international registration
If the applicant requests extended protection based on UK registration or Madrid designated UK registration, they may apply for extended protection in Turks and Caicos at any time during the validity period of the trademark. If the applicant does not reside in Turks and Caicos, they must entrust a local specialized agent to handle it. The basic materials required for trademark application are:
1. Trademark design;
2. Specific product items;
3. Name and address of the applicant;
4. Proof of registration in the UK or designated UK registration in Madrid;
For applications for extended protection based on UK registration or Madrid designated UK registration, registration generally takes about six months, and a registration certificate will be issued after the trademark is approved. Trademark rights come into effect from the date of registration in the UK, but in the event of trademark infringement disputes in the region, they can only be initiated if the local government of Turks and Caicos also approves protection. If extended protection is based on UK registration, the validity period of the trademark will remain consistent with the UK's basic registration.
(2) Apply for protection directly in the country
Applicants can also register in a single country locally. If the applicant does not reside in Turks and Caicos, they must entrust a local specialized agent to handle it. The basic materials required for trademark application are:
1. Trademark design;
2. Specific product items;
3. Name and address of the applicant;
4. Power of attorney. Turks and Caicos adopts the Nice classification and does not accept applications for multiple categories. Trademark registration generally takes about six months, and a local registration certificate will be issued after approval.
The Turks and Caicos trademark is valid for 10 years after registration, starting from the date of application; Renewal can be processed within 6 months before the expiration date, with a grace period of 6 months; The renewal is valid for 10 years.
For requests to extend the protection of the Turks and Caicos Islands based on UK registration or Madrid designated UK registration, the renewal must be completed for the trademark that was originally registered.
Once a trademark is approved for registration in the Turks and Caicos Islands, an annual fee must be paid to the Turks and Caicos Islands government in January each year. Multiple annual fees can be arranged to be paid at once, and failure to pay the annual fee will result in the temporary suspension of trademark rights.
